The Problem: An asbestos consultant insured by XL Environmental performed a Phase I site assessment identifying a specified quantity of asbestos on a site being purchased by a land owner. When the land owner had to pay for the removal of additional asbestos found on the site, he filed suit against the consultant for the allegedly faulty Phase I report.

The Response: XL Environmental immediately dispatched an environmental attorney and environmental consultant to inspect the site and the Phase I report in question. After thorough review of the Phase I and the claimant’s supporting documentation, XL Environmental determined that the consultant had performed a reasonable and adequate assessment of the site. Realizing he was unlikely to win, the claimant dropped the claim.
